Abstract

The increase in identified HIV seropositive prisoners in Australia's prisons raises serious questions concerning legal obligations within the prison community. Norberry examines some of these issues. Topics discussed include: United States cases involving HIV/AIDS; prison conditions and prisoners' rights; duty of care; legal liability for HIV transmission; and occupational health and safety issues.
